Agreement to Terms

These Terms and Conditions ("Terms") govern your use of Zyracore's website and services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Services

Zyracore provides web design, development, and related services as outlined on our website and in individual project agreements. Our services include:

• Website design and development
• E-commerce solutions
• Website maintenance and support
• Content management system (CMS) integration
• Performance optimization
• Other related web services as agreed

Project Process

1. Discovery & Quote

After initial consultation, we provide a fixed-price quote outlining the project scope, deliverables, timeline, and cost. The quote is valid for 30 days.

2. Agreement & Deposit

Upon acceptance of the quote, we require a 50% deposit to commence work. The remaining 50% is due upon project completion before final delivery.

3. Development

We develop your project according to the agreed specifications. You will have opportunities to provide feedback at agreed milestones.

4. Review & Revisions

Each package includes a specified number of revision rounds. Additional revisions may incur extra charges.

5. Launch & Handover

Upon final payment, we launch your website and provide all source files, access credentials, and training as agreed.

Payment Terms

Payment Schedule

• 50% deposit required to start the project
• 50% due upon completion before final delivery
• Payment accepted via bank transfer or major credit cards

Late Payment

Final delivery will not occur until full payment is received. We reserve the right to suspend work or cancel the project if payment is delayed beyond 30 days.

Monthly Care Plans

Monthly care plan subscriptions are billed in advance. You may cancel with 30 days' written notice. No refunds for partial months.

Client Responsibilities

To ensure timely project completion, you agree to:

• Provide all necessary content, materials, and information in a timely manner
• Provide clear, consolidated feedback within agreed timeframes
• Ensure you have rights to all materials provided (text, images, logos, etc.)
• Respond to queries and requests within 7 business days
• Make timely payments as agreed

Delays caused by failure to meet these responsibilities may result in project timeline extensions and potential additional charges.

Intellectual Property & Ownership

Client Ownership

Upon full payment, you own 100% of the custom code and design files created specifically for your project. This includes:

• Custom website source code
• Design files and assets
• Content management system data
• Logos and graphics created for your project

Third-Party Components

Projects may include third-party components (frameworks, libraries, fonts, stock images) subject to their respective licenses. We ensure all third-party components are properly licensed for commercial use.

Portfolio Rights

We reserve the right to display completed projects in our portfolio and marketing materials unless confidentiality is explicitly agreed in writing.

Refund Policy

Starter Package (£599)

7-day money-back guarantee if you are not satisfied with the initial design. Refund applies to the deposit only if requested before development begins.

Other Packages

Deposits are non-refundable once work commences. If you wish to cancel mid-project, you will be charged for work completed to date, calculated on an hourly basis.

Care Plans

Monthly care plans can be cancelled with 30 days' written notice. No refunds for the current billing period.

Warranties & Guarantees

Performance Guarantee

We guarantee Lighthouse performance scores of 95+ on completion. If we fail to achieve this, we will optimize at no extra cost.

Post-Launch Support

Each package includes a post-launch support period (7-30 days depending on package) to address any technical issues or bugs.

No Warranty for Third-Party Services

We are not responsible for issues caused by third-party services (hosting providers, payment processors, etc.) outside our control.

Limitation of Liability

To the fullest extent permitted by law:

• Our total liability shall not exceed the total amount paid by you for the specific service in question
• We are not liable for indirect, incidental, special, or consequential damages
• We are not liable for loss of profits, revenue, data, or business opportunities
• We are not liable for downtime, data loss, or security breaches of third-party services

Hosting & Maintenance

Included Hosting

Initial hosting periods are included as stated in each package (6-24 months). After this period, you may:

• Subscribe to a monthly care plan (includes hosting)
• Take over hosting independently (we provide guidance)
• Arrange alternative hosting with our assistance

Self-Hosting

You are free to host your website anywhere. We provide all necessary files and instructions. We use Cloudflare Pages which offers a generous free tier.

Termination

By Client

You may terminate the project at any time. You will be charged for work completed to date. Deposits are non-refundable.

By Zyracore

We reserve the right to terminate the project if:

• Payment is not received as agreed
• You fail to provide necessary materials or feedback
• You request illegal or unethical work
• The working relationship becomes untenable

Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
